    Terms and Definitions

    • Site — an information resource located at the network address https://adverts.am in the information and telecommunications network «Internet», comprising software for electronic computers, data contained therein, intellectual property objects (including, but not limited to, computer programs, databases, graphic elements, etc.), and functioning as a reference and catalog directory designed to facilitate interaction among Users of the information and telecommunications network «Internet» for the purpose of buying and selling, exchanging, and/or transferring the use of movable and/or immovable property, performing works, providing services, searching for suitable employment and/or recruiting necessary personnel, as well as for other lawful purposes, by providing Users with the ability to independently post advertisements.
    • User — any legally competent natural person who has the ability to use the functions and services of the Site.
    • Advertisement — an informational message from a User, stored in the Site's database, addressed to an indefinite circle of persons regarding the purchase and sale, exchange, and/or transfer of use of movable and/or immovable property, performance of works, provision of services, search for suitable employment and/or recruitment of necessary personnel, as well as for other lawful purposes.
    • Site Administration — the entity or person that owns and operates the Site.
    • Posting of an Advertisement — a process initiated by the User for placing an Advertisement on the Site through the operation of computer software without the participation of the Site Administration.

    General Provisions

    • The Site Administration provides the User with the ability to use the Site, its functions, and services under the terms set forth in this Terms of Use Agreement (hereinafter referred to as the Agreement).
    • Please read the terms of this Agreement carefully to avoid future misunderstandings or disputes. If you do not agree with any provision of this Agreement, or if any future changes to the Agreement are unacceptable to you, please refrain from using the functions and services of the Site. By continuing to use the functions and services of the Site, you automatically agree to the terms outlined in this Agreement.
    • Accessing additional paid services of the Site (hereinafter referred to as Paid Services) does not exempt the User from complying with the provisions of this Agreement.
    • This Agreement may be modified and/or supplemented at the sole discretion of the Site Administration, without prior notice to the User, by publishing the corresponding changes to the Agreement on the Site. The effective date of any changes to this Agreement shall be the date of their publication on the Site. The User, while using the Site, its functions, and services, agrees to independently review the current terms of the Agreement, available on the Site at the network address https://adverts.am/help/terms_of_service/

    Subject of the Agreement

    • The Site Administration provides the User with round-the-clock access to the Site, except during scheduled maintenance periods or other circumstances beyond the control of the Site Administration, in accordance with the terms of this Agreement.
    • This Agreement does not create or imply any financial obligations between the Site Administration and the User (hereinafter collectively referred to as the Parties), nor does it require any financial settlements between the Parties, except for the User's voluntary use of the Site's Paid Services, as described in the Site's Public Offer available at https://adverts.am/help/oferta/
    • The Site Administration does not derive any financial benefit from the User upon the User posting an Advertisement on the Site.
    • The Site Administration is not a party to, organizer of, buyer, seller, employer, intermediary, agent, representative of any User, beneficiary, or otherwise interested party in transactions conducted between Users.
    • The Site Administration does not modify Advertisements posted by Users on the Site.
    • Users utilizing the functions and services of the Site bear sole responsibility for materials posted on the Site in accordance with the legislation of the Russian Federation.
    • Users utilize information posted on the Site to conduct transactions at their own risk, without direct or indirect participation, control, or supervision by the Site Administration.
    • The functions and services of the Site may be modified, expanded, or discontinued at any time without prior notice to the User.

    Rights and Obligations of the User

    • The User has the right to modify personal information in the personal account on the Site.
    • The User is entitled to post an unlimited number of advertisements on the Site, provided they do not violate the terms of this Agreement. Registered Users are granted the right to edit, delete, and bump previously published advertisements in search results (subject to established frequency limits).
    • When providing contact information and publishing advertisements on the Site, the User is obligated to provide accurate, complete, and up-to-date information.
    • The User agrees to comply with the terms of this Agreement.
    • The User is strictly prohibited from posting Advertisements of the following nature and content:
      • Materials violating the Criminal Code of the Russian Federation or leading to civil law offenses.
      • Alcohol, narcotics, tobacco, smoking mixtures:
        • Any nicotine-containing products — items containing nicotine (including synthetic nicotine) or its derivatives, including nicotine salts, intended for nicotine consumption and delivery via sucking, chewing, sniffing, or inhalation, including heated tobacco products, solutions, liquids, or gels containing liquid nicotine, nicotine-containing liquids, powders, or mixtures for sucking, chewing, or sniffing.
          Empty packaging and containers for any nicotine-containing products.
          Certificates, coupons, or promo codes for the purchase of any nicotine-containing products.
          Services related to the search, purchase, or sale of any nicotine-containing products.
        • Any smoking mixtures (including tobacco-free and nicotine-free ones).
          Empty packaging and containers for any smoking mixtures.
          Certificates, coupons, or promo codes for the purchase of any smoking mixtures.
          Services related to the search, purchase, or sale of any smoking mixtures.
        • Any smoking devices and accessories («electronic cigarettes», hookahs, etc.), components thereof, and smoking accessories.
          Empty packaging and containers for any smoking devices.
          Certificates, coupons, or promo codes for the purchase of any smoking devices and accessories.
          Services related to the search, purchase, sale, or repair of any smoking devices and accessories.
        • Any alcoholic beverages, including ethyl and methyl alcohol.
          Empty packaging and containers for any alcoholic products.
          Certificates, coupons, or promo codes for the purchase of any alcoholic products.
          Services related to the search, purchase, or sale of any alcoholic products.
        • Any narcotic and psychotropic substances.
          Services or activities related to the search, purchase, or sale of any narcotic or psychotropic substances, including any services or activities that raise suspicion from the Site Administration regarding such activities. The Site Administration reserves the right to refuse publication of an Advertisement if there is suspicion that the submitted Advertisement relates to such activities.
        • Food-grade nicotine-containing products.
          Empty packaging and containers for any food-grade nicotine-containing products.
          Certificates, coupons, or promo codes for the purchase of any food-grade nicotine-containing products.
          Services related to the search, purchase, or sale of any food-grade nicotine-containing products.
      • Medicine and Health:
        • Any medical services provided by individuals, including medical massage (only cosmetic massage is permitted).
        • Pharmaceuticals and dietary supplements (BAAs).
        • Medical devices and equipment provided by individuals.
        • Medicinal raw materials provided by individuals.
        • Services and products related to so-called «folk medicine», services of various «healers».
        • Human organs and tissues, donor services, and surrogate motherhood services.
      • Animals and Plants:
        • Animals and plants listed in the Red Book of the Russian Federation or protected by international treaties.
        • Taxidermy mounts, pelts, bones, etc. Any goods or products made from them.
        • Poaching equipment (electrofishing devices, traps, nets, snare traps, etc.).
        • Zoos and services involving the use of animals (photo sessions with animals, contact zoos, animal shows).
      • Financial Services and Valuables:
        • Loans, credits, financial intermediation, debt collection services.
        • Financial pyramids, get-rich-quick schemes, gambling, lotteries, casinos, and related equipment.
        • Cryptocurrencies and mining equipment.
        • Precious metals and stones (except for jewelry).
      • Weapons:
        • All types of cold and firearms, including: combat small arms and cold weapons, service weapons, civilian weapons (self-defense, sports, hunting, signal, cold bladed), collector's items, deactivated weapons, throwing weapons, pneumatic weapons, etc.
        • Mass-dimensional mock-ups (inert replicas) of weapons.
        • Any spare parts and components for weapons.
        • Civilian self-defense items: batons, stun guns, pepper spray, etc.
        • Weapon repair and tuning services.
        • Weapon training services.
        • Assistance in obtaining weapon licenses.
      • Personal Data:
        • Disclosure of any personal data of citizens in advertisements (full name, phone number, contact details).
        • Defamation or offensive messages directed at a specific person or group of persons.
      • Other:
        • Advertising online stores as the primary purpose of the advertisement, i.e., if the advertisement promotes the online store itself rather than a specific product from the store.
        • Charitable foundations, NGOs, communities, sects, religious organizations.
        • Occult services, magic, fortune-telling, etc.
        • Advertising websites and portals.
        • Counterfeit goods and pirated products. Replicas and counterfeit branded items.
        • Services for writing (including assistance in writing) term papers and theses, as well as their sale.
        • Intimate services and facilitation of such services (pimping). Erotic or pornographic goods and products.
        • Document forgery.
        • SIM cards and mobile network connection services.
        • State awards of the Russian Federation, RSFSR, USSR, as well as their copies, mock-ups, and replicas.
        • SPAM services, software cracking, artificial inflation of votes, likes, etc.
        • Vehicle inspection services, sale of diagnostic cards, CASCO, OSAGO insurance policies, and similar offers.
        • Residency registration services.
    • The User is prohibited from doing the following on the Site:
      • Exploiting software errors for personal gain.
      • Interfering with the source code.
      • Using any malicious scripts, programs, or software tools containing viruses and other destructive elements.
      • Using any automated or semi-automated programs to publish advertisements.
    • The User is prohibited from posting an advertisement in a category if the theme of the category does not match the theme of the advertisement itself.
    • The User is prohibited from extracting, modifying, decompiling the source code, or creating any derivative projects that use the code or code fragments of this Site.

    Rights and Obligations of the Site Administration

    • The Site Administration undertakes not to disclose personal information provided by the User during registration and not featured in advertisements, and not to transfer it to third parties, except in cases stipulated by the legislation of the Russian Federation.
    • The Site Administration reserves the right to store information regarding the User's IP address, store contact information and email address, and set cookie files in the User's browser to ensure the proper functioning of the Site.
    • The Site Administration reserves the right to permanently delete advertisements and/or indefinitely restrict access to the Site (or to specific functions and services of the Site) for Users who violate the terms of this Agreement, without any prior notice.
    • As an information intermediary, pursuant to Article 1253.1 of the Civil Code of the Russian Federation and Resolution No. 10 of the Plenum of the Supreme Court of the Russian Federation dated April 23, 2019, the Site Administration undertakes to promptly respond to requests from rights holders to take action regarding the discovery of their intellectual property elements on the Site.

    Disclaimer

    • The User agrees that they use the Site and information from the Site at their own risk, acknowledging that the Site serves solely as an information intermediary between the User and an indefinite circle of persons.
    • The User fully acknowledges that whenever they voluntarily publish their personal contact or other data on the Site, such information may be collected and used by third parties. The Site Administration shall not be held liable for the actions of third parties.
    • The Site Administration does not guarantee that:
      • The software, functions, and services provided by the Site will fully meet the User's requirements and expectations.
      • The functions and services of the Site will be provided uninterrupted, timely, and without errors.
      • Results and information obtained by the User on the Site will be accurate, reliable, up-to-date, or will fully meet the User's requirements and expectations.
      • The quality of any goods, services, information, and other materials obtained or acquired by the User through the Site will fully meet the User's requirements and expectations.
    • No recommendations or information, whether obtained orally or in writing from the Site Administration or through the Site, shall impose any warranties on the Site Administration beyond those expressly stated in this Agreement.
    • Under no circumstances shall the Site Administration be liable to the User or third parties for any direct, indirect, incidental, special, or consequential damages, including but not limited to lost profits, loss of use, loss of data, or any other intangible losses, reputational damage, or other damages (even if the User or third parties were advised of the possibility of such damages).
